The Select Committee recently published a list of 'Main Company Contacts' provided by Ian Kerr of the Consulting Association. The list is detailed here:

One of these 'Main Contacts' was Paul Raby who has been employed as the Human Resources Director at Balfour Beatty PLC since 2005.

I met with Paul in 2005 and he subsequently became aware of the concerns I was raising about being Blacklisted by the company. Both Paul Raby and Micky Tuff from the Amicus/Unite were copied my resignation letter to David Beck dated 9 January 2006, which goes into detail about my concerns about the company's Blacklisting procedure. Neither responded or did anything to help me. The letter has been available on this website since 2009.

I have therefore today written to the six Non-Executive Directors of Balfour Beatty Plc (Graham Roberts, Hubertus Krossa, Iain Ferguson, Mike Donovan, Robert Amen and Maureen Kempston-Darkes) to draw their attention to Paul Rabys' involvement in all this.

I recently attended a meeting with the Shadow Secretary of State for Business, Chuka Umunna on 29 January 2013. This after he'd learned that senior officials at the Amicus/Unite trade union and senior civil servants in the previous Labour Government were in possession of all my Blacklisting evidence as far back as 2005/2006 and did nothing with this. This evidence was no more or less information that David Clancy at the ICO eventually used to locate and close down the Consulting Association back in 2009.

The cozy financial relationship (and possible reason for covering this up back then) between the trade unions that fund his party and the member companies of the Consulting Association has finally been broadcast by the BBC.

The show also focused on the fact that senior officials within the last Labour Goverment had all my evidence back in 2006/2007 and did nothing with this.

My take on the meeting was that it was a fishing exercise to establish what else I knew about the relationship between the respective parties.

During the meeting I raised a point about Luciana Berger MP who had praised the efforts of the trade union Ucatt in exposing the Consulting Association back in 2009 in the live debate in the House of Commons on 23 January 2013. This was totally untrue and she misled the House. Ucatt had absolutely nothing to do with exposing the CA back then or at any time before this. Chuka brushed this point aside during our meeting.

I therefore emailed him regarding this a couple of days later, and to date I have yet to receive a response from him on this following numerous prompts.

It amazes me how he wants to meet me one day to discuss the Blacklisting, but then faced with the truth about his own party and the trade unions that fund it, he won't even reply to an email.

Here is the email to Chuka:

Dear Chuka

Thank you for meeting me the other day. Your support in this matter is much appreciated.

I would like to draw your attention to the intervention of Luciana Berger in the debate on 23 January 2013, in which she praises the efforts of the Ucatt union in exposing the Consulting Association in 2009.

CU: "Trade unions including Ucatt, Unite and GMB have also unearthed much evidence, in addition the Blacklist Support group".

LB: "I thank my honorable friend for very kindly giving way into his speech and I listened very carefully to what he said. I’m a proud member of Ucatt and would he agree, that as he mentioned before that the work that they have done on behalf of their members, construction workers up and down the country, led to what we saw in 2009 and if it hadn’t been for their arduous work that they’ve carried out for many decades that we wouldn’t be in the situation we are now, but we’ve still got a long way to go".

CU: "I completely agree with the comments of my honorable friend".

This is simply not true and very insulting to the people who did actually contribute to the exposure of the Consulting Association in 2009. I'd mentioned in my previous email that the Ucatt trade union had absolutely nothing to do with this before 2009 and that their former General Secretary, Alan Richie apologized to me in person after I gave my evidence to the select committee, stating in his words that he totally missed this before it was exposed in 2009.

I've since learned from Michael Dooley, that Alan Richie was recently removed from office following an order from the certification officer and subsequently resigned after an investigation was launched into his expenses. This man is now advising the select committee! 

David Clancy from the ICO has just this morning confirmed to me that no trade union was involved in the efforts to expose the Consulting Association before 2009.

I therefore put it to you that Luciana Berger has misled the House and think you should both publicly apologise and set the record straight on the people whose efforts actually did contribute to the eventual exposure of Ian Kerr and the Consulting Association back in 2009.

Have you any idea how insulting and annoying it is to hear MP's praising the efforts of complicit trade unions, whilst on the same hand ignoring the efforts of those who have struggled for so long to expose this? It came as no surprise this morning to learn that Luciana's constituency office is located in the Ucatt Building on Derwent Road in Liverpool.

Were Ian and Mary Kerr blacklisting innocent people themselves by collating and distributing data to the member companies?

In evidence to the Select Committee, Ian Kerr stated that he created mailshots to the member companies. We learned yesterday from his wife, Mary that Kerr spent three days burning evidence after the ICO raid in 2009. She also said yesterday that Kerr spent the last two weeks of his life correcting his evidence and it was the stress of this that killed him.

Both Ian Kerr and his wife have also stated on record that the member companies of the Consulting Association were the single primary source of all the information on the Blacklist files, which was identified with a company code and the initials of the HR Manager or Director providing the information.

But this cannot be true!

A Consulting Association Blacklist file on me was recovered by David Clancy at the ICO in the raid in 2009 and I've provided links to the five pages contained in this below. The file details information about me giving evidence at a Tribunal (which was successful for the Claimants) and has two press cuttings. The first page has been typed out, presumably by Mrs Kerr.

In the absence of any Construction company code or HR source initials, I can only presume that this file was created and distributed to the member companies by Mr and Mrs Kerr in the mailshots they refer to.

If that's not Blacklisting, I don't know what is...

I'm happy to stand corrected on this, but I'm pretty sure I'm spot on. 

In the years leading up to 2005/2006, when I became unemployed and subsequently placed on the Consulting Association files for trying to expose the Blacklisting, the following financial arrangements existed:

The Labour Government to the Construction Companies

The Labour Government awarded contracts to the tune of hundreds of millions of pounds to the member companies (approximately 40 of the UK's leading Construction companies) of the Consulting Association.

The Construction Companies to the Trade Unions 

Some of the member companies of the Consulting Association (those in mechanical and electrical contracting or those with an M&E subsidiary like Carillion and Balfour Beatty) paid the weekly trade union subscription fees of all their electrical employees to Amicus/Unite under a JIB benefits scheme in force at the time. In my role as National Labour Manager at Carillion, I can confirm that we had approximately 1000 electrical operatives at the time, so my math has that at approximately 100 grand a year for one company alone. 

I can also confirm that money was paid weekly to Amicus/Unite for all temporary agency workers engaged on our projects (two pounds per person per week), following a threat from Frank Westerman that they would target and expose our use of agency labour, which was a contravention of one of the working rule agreements at the time.

The Trade Unions to the Labour Party

The trade unions funded the Labour Party to the tune of millions of pounds.

In August 2005, a senior trade union official, Micky Tuff (Amicus/Unite) came into possession of all the key blacklisting evidence in my possession. I gave it to him after he accompanied me to my grievance hearing with Haden Young. This included all the Haden Young Blacklisting fax check sheets and the memo from Sheila Knight c/w the lists of 500 names from the Jubilee Line, Pfizer and Royal Opera House projects. This was no more or no less evidence than David Clancy at the ICO used to expose Ian Kerr and the Consulting Association in 2009.

I have already published my three letters to Derek Simpson in 2006 and my letters to Gail Cartmail and her response in 2012, so here are the four letters to Micky Tuff in January and February 2006. I'm a fully paid up trade union member and he ignores these letters and all my telephone calls.

I will soon be publishing a written statement from a whistleblower from within that trade union which supports my belief that Micky Tuff was told to cover up the Blacklisting evidence and do nothing with it at the time by senior management. 

This person names at least one time and place where they discuss the Blacklisting evidence and goes on to say "He confided in me because we were good pals. I've not seen him much since, but whenever I spoke to him, and even until recently, he just says to me", "they told me I had to leave it [Name], the bastards".

This person also talks about Gail Cartmail and says "She is there, and is another who will not let him go with it, because they are worried about what might come out from the Union which might lead to them getting sued. Think about it - they'll fuck him up if he takes it on".

But all in good time. Let's see how long Amicus/Unite continue to deny they had any involvement in containing this back then. Please note that two of the letters are dated 2005 in error, but they are 2006.
